T-shirts and Copyright InfringementObtaining the rights to use a design, symbol, word, or phrase is how many companies in the US protect the designs that appear on printed T-shirts from being used by competitors. While mistakes are sometimes made and designs that are already under copyright are used, businesses that violate this law are asked to discontinue selling shirts and other printed items without penalty. If they refuse, the owners of the design can take them to court and force them to stop using it.

Nite Owl T-shirts, based in Port Allan, Hawaii, USA, knows the sting of copyright infringement all too well. One of their most popular designs, 'Kimo's Hawaiian Rules', which lists ten optimistic rules to living a long, happy life, has been copied by another t-shirt printing company, Paradise Sportswear Hawaii. The two companies share the same production space and have been friendly for a long time.

Rita Peeters, the owner of Nit Owl T-shirts, had the design copyrighted in 1991. It was in 2004 that Peeters noticed her design was being used on their t-shirts. Similar copyright issues occurred on two other islands in Hawaii by other businesses which Peeters was also made aware of. She has since taken legal action against them.

“It upsets me. I know what the issues are and I’m personally sensitive to my intellectual property," said David Christy, art director for Nite Owl. He has talked with Paradise Sportswear Hawaii owner Randy Williams, but the shirts are still being printed.

While everyone would like the issue resolved without having to go to court, Peeters says she will do what she has to in order to protect her design. “I’d be happy if it just stopped. If (Williams) refuses, that’s another story. As far as longevity of a business, honesty will prevail," said Peeters.
